Boating Accidents

Florida leads the nation in the number or recreations boats and boating accidents. According to the Florida Fish and Wildlife Conservation Commission Division of Law Enforcement, out of 896,632 registered vessels there were 736 reportable boating accidents and 62 boating fatalities (including 8 missing persons) in 2013. Additionally:

  • Accidents involving personal watercrafts made up 19% of total reportable boating accidents.
  • Miami-Dade country reported the highest number of accidents and injuries, with 104 total accidents resulting in 50 injuries and 4 fatalities
  • 420 injuries were reported because of the 736 total accidents, meaning that 57% of boating accidents resulted in injury to one or more people.

Determining liability in maritime accidents can be challenging for many reasons. Gathering evidence for litigation may require detailed investigations into records that may not be very sophisticated or accurate, and witness statements that may not be reliable.

Like a car accident, a recreational boating accident has many factors to consider such as liability and insurance coverage. Do the parties involved have insurance? Does it cover injuries? Since 2011, insurance is optional on recreational boats in Florida. Unless the boat is financed, where the lender would require insurance, or resides at a marina that requires coverage, the decision to purchase boat insurance is left up to the owner.

The skilled maritime attorneys at the Shaked Law Firm know what questions to ask to carefully reconstruct what happened. Using physical evidence, witness statements and testimonies from experts, they can recreate the scene of the accident and determine liability in a court of law.

Maritime Law

Another important aspect to consider is whether the boating accident will be subject to maritime law. Maritime activity can be applied to recreational boating if the accident occurs in €œnavigable waters€ and has the potential to disrupt maritime commerce. Some of these laws may seem logical, while some old fashioned. For example, liability can be drastically limited if the accident was determined to have been caused by circumstances outside of the owner’s control.

Boating accidents, can and do happen for many reasons, but if you are the victim of an accident because of someone else’s negligence you are entitled to fair and reasonable compensation for your injuries.
